Surrogacy India news – In a welcome move, the High Court in Madras has ordered that a mother who had a child from a surrogate following a surrogacy arranagement is entitled to maternity leave in addition to securing medical benefits for the child.

This is a welcome move following the recent negative press on surrogacy laws in India. India recently issued a directive with strict requirements for couples choosing surrogacy in India.  Most controversially, India does not permit surrogacy for single or gay couples. Existing contracts for surrogacy by couples who do not meet the criteria may be honoured but you are advised to seek legal advice for clarity. Do not take risks or make assumptions.

Any couples wishing to enter into a surrogacy arranagement should get legal advice before the process begins.  Each country has different rules and regulations on surrogacy.  In order to prevent disapppointment and expense later on, please seek advice.  We have experience in dealing with surrogacy India cases.
